Business Conflict Resolution: Solving the Right Problem Before It Becomes a Bigger One

First, identify the real business problem and not just the legal issue. While legal claims are important, successful outcomes begin by understanding the business objectives behind the dispute. Looking beyond the courtroom allows companies to pursue solutions that make commercial sense while protecting long-term interests.

Second, resolve disputes strategically and as early as possible. Jennifer emphasized that timing can dramatically affect the outcome of a dispute. Conducting an early case assessment, honestly evaluating risk, and choosing the right resolution strategy can often save significant time, expense, and disruption. Not every dispute belongs in court, but not every dispute should be settled immediately either.

Finally, focus on protecting the business after the dispute is over. The best resolutions don’t simply end litigation, they position the business for future success. A thoughtful strategy helps strengthen governance, clarify responsibilities, and reduce the likelihood of similar conflicts arising again.
