Jones, III ruled that the plaintiffs had presented no evidence showing that the defendants acted with intent when they deleted the email account of the former Assistant Superintendent, nor had a duty to preserve arose prior to the deletion of the account.

In Singh et. al. v. Hancock Natural Resources Group, Inc. et. al., California Magistrate Judge Jennifer L. Thurston granted the defendants’ motion to compel (in part), ordering the plaintiffs’ to “produce all emails and other documents sought by the defendants in the format demanded with the accompanying metadata from the native computer”.
